When Testing Is Finished
When the Child Study Team completes
the evaluation, they convene an
eligibility committee meeting to review
the assessment results and determine if
the student qualifies for special
education and related services, as
defined in state regulations pertaining to special education (N.J.A.C. 6A: 14). Participants on the committee for this student must include:
- One of the student's general education teachers
- The parent
- At least one Child Study Team member who participated in the evaluation
- The student if appropriate
The Child Study Team case manager will participate and may be the only Team member at the meeting if he or she also participated in the evaluation. Other appropriate individuals at the discretion of the District or the parent may attend; the teacher making the referral and the administrator of the building may participate if they so choose.
The eligibility committee reviews evaluation reports and all data to determine if the student meets eligibility criteria and provides the parent with written notice about the outcome. The meeting may then end or, if the student is classified and the parent agrees, continue with a discussion of the Individualized Education Program (IEP). The parent has the right to defer the IEP discussion, consider the eligibility decision for 15 days, and have a second meeting.
If the student meets eligibility criteria, the number of participants in the
discussion of the IEP must be expanded to include a special education teacher.
This group of people is defined in the Administrative Code as the IEP Team. If
the IEP Team is likely to be discussing transition services for older students,
a representative of an agency likely to be responsible for these services is
also invited.
